Scope: This document constitutes a legally binding agreement between DigiTechPak.com (the Platform) and the Registered Seller (the Vendor).
Step 1: Onboarding, Quality, and Mandatory Thresholds
To ensure the marketplace remains a premium destination, we maintain strict entry requirements.
- 1.1 The Five-Product Activation Rule: Every new vendor is required to upload a minimum of 5 unique and high-quality digital products to qualify for their first payout. This threshold ensures your storefront looks professional and trustworthy to buyers.
- 1.2 Content Ownership Warranty: By uploading any file, you warrant that you are the sole creator or possess a valid commercial resale license. The sale of “Nulled,” “Cracked,” or “GPL-stolen” scripts without substantial modification is strictly prohibited.
- 1.3 Quality Control (QC): Every product goes through a manual review. Listings with broken links, low-resolution preview images, or “thin” descriptions will be rejected.
Step 2: The Revenue, Tax, and Commission Engine
Our financial model is designed for 2026 compliance and maximum vendor profit.
- 2.1 Base Vendor Commission: You receive 70% of the gross sale price for every direct sale.
- 2.2 The 5% Fixed Compliance Fee: To cover the heavy lifting, a flat 5% is deducted from the total sale.
- 2% Digital Sales Tax: Handled by DigiTechPak as an “Intermediary” under Section 3(7A) of the Pakistan Sales Tax Act. This is your final tax discharge.
- 3% Infrastructure Fee: Covers server hosting, secure download encryption, and payment gateway (JazzCash/EasyPaisa/Visa/Mastercard) processing costs.
- 2.3 Affiliate Sales Deduction: If a sale is generated by a DigiTechPak Affiliate:
- The Affiliate Commission (35% for new / 50% for Legacy members) is deducted first.
- The remaining amount is then split according to the vendor/platform ratio.
- Example: For a $100 sale with a 35% affiliate, the vendor receives 70% of the remaining $65.
Step 3: Payout Cycles and Financial Security
- 3.1 Bi-Monthly Processing: Payouts are not instant to allow for a “Security Buffer” against fraudulent transactions.
- 3.2 The 1st-to-4th Window: All withdrawal requests are processed between the 1st and 4th of each month.
- 3.3 Financial Privacy: Your earnings and payout methods are never shared. However, to comply with the Prevention of Electronic Crimes Act (PECA), we may require a private CNIC or NTN verification before the first payout is released.
Step 4: Account Vitality & The “Dormancy” Rule
We do not allow “ghost” accounts to clutter our search engine rankings.
- 4.1 The 90-Day Activity Rule: If an account has no login activity, no product updates, or no new uploads for 3 consecutive months, it will be automatically disabled.
- 4.2 Data Retention: Disabled accounts will have their products “hidden” from the public but the data is kept for 12 months should the vendor wish to return.
Step 5: The “Gold Standard” Refund Policy
Digital products are non-tangible assets. To prevent “Download & Refund” scams, we follow a strict Exception-Only policy.
Refunds will ONLY be considered if:
- Access Failure: The customer paid but the system failed to provide the download link.
- Corruption: The digital file (ZIP/PDF/EXE) is corrupt and cannot be opened.
- The “7-Day Technical Fix” Rule: If a major bug is reported that makes the product unusable, the vendor has 7 days to provide a patch. If the vendor fails or ignores the request, a refund is issued from the vendor’s balance.
- Major Misrepresentation: The product description promises a feature (e.g., “Mobile Responsive”) that is completely missing.
Step 6: Intellectual Property (DMCA) & Safety
- Takedown Procedure: If we receive a valid DMCA notice regarding your product, it will be removed immediately.
- Circumvention: Any vendor caught telling customers to “DM me on WhatsApp for a lower price” to bypass the 5% fee will have their account permanently banned without payout.
- Liability: DigiTechPak is a platform provider. We are not liable for any data loss or security breaches caused by a vendor’s software or code.
Step 7: Licensing and Usage Rights
- 7.1 Standard License: By default, all products sold on DigiTechPak are issued under a Standard License. This grants the buyer the right to use the product for one single project or end-product.
- 7.2 Extended License: Vendors may offer an “Extended License” (allowing for multiple projects or redistribution) only if explicitly stated and priced in the product description.
- 7.3 Intellectual Property: A sale does not constitute a transfer of copyright. The Vendor remains the legal owner of the original intellectual property; the buyer is only granted a non-exclusive usage right.
Step 8: AI-Generated Content Disclosure
- 8.1 Transparency Requirement: In alignment with 2026 global digital standards, vendors must disclose if a product (Source Code, Graphics, or Written Content) is “AI-Generated” or “AI-Assisted.”
- 8.2 Misrepresentation: Claiming AI-generated work as “100% Human-Made” is considered a violation of platform integrity. If discovered, it may result in an immediate refund to the buyer and a strike against the vendor’s account.
Step 9: Anti-Money Laundering (AML) and Fraud Prevention
- 9.1 Prohibition of Self-Purchasing: Vendors are strictly prohibited from purchasing their own products through alternative accounts to inflate sales figures or circumvent withdrawal limits.
- 9.2 Transaction Audits: Any suspicious or rapid sales spikes will trigger a 15-day Payout Hold. During this period, the DigiTechPak Security Team will verify the legitimacy of the transactions before funds are released.
Step 10: Merchant of Record (MOR) & Legal Liability
- 10.1 Platform Role: DigiTechPak operates as the Merchant of Record (MOR). We take responsibility for payment security and the collection of the 2% Digital Sales Tax at the source.
- 10.2 Warranty Disclaimer: All digital products are provided “As-Is.” DigiTechPak is not liable for any technical damages, data loss, or server crashes caused by the installation or use of vendor-submitted files.
Step 11: Support Service Level Agreement (SLA)
- 11.1 Support Deadlines: To maintain our 5-star marketplace reputation, vendors are required to provide a response to customer support tickets or queries within 48 to 72 business hours.
- 11.2 Support Negligence: Consistent failure to assist buyers with functional issues will lead to the automatic application of the “7-Day Refund Rule” and potential suspension of the vendor’s storefront.
Step 12: Platform Circumvention (Direct Payment Policy)
- 12.1 Transaction Integrity: Redirecting DigiTechPak customers to external payment methods (e.g., WhatsApp, Private Bank Transfers, or external wallets) to bypass the 5% Platform Fee is strictly prohibited.
- 12.2 Enforcement: Any attempt to circumvent the platform’s payment engine will result in the permanent termination of the vendor account and the forfeiture of any remaining balance.
Step 13: “Dark Patterns” & Deceptive Design
- 13.1 Clear Pricing: You must not use “Dripped Pricing” (adding hidden fees at the very last second of checkout). The 5% fee and any taxes must be clearly visible or explained before the user clicks “Pay.”
- 13.2 Easy Cancellation: If you ever offer subscriptions for your WordPress services, there must be a “One-Click Cancel” button. Making it hard for users to leave is a violation of 2026 “Digital Fairness” laws.
Step 14: Data Portability & “Right to be Forgotten”
- 14.1 Vendor Data Export: If a vendor chooses to leave DigiTechPak, they have the right to request a CSV/Excel export of their sales history and product metadata.
- 14.2 Account Deletion: If a user or vendor requests to delete their account, you must remove their personal data (Email, Phone, CNIC) from your active database within 30 days, unless required for tax audits.
15. Advertising Transparency
- 15.1 “Sponsored” Labels: If you allow vendors to pay you to “Feature” their products on the homepage, these must be clearly labeled as “Sponsored” or “Ad.”
- 15.2 No Minority Targeting: You cannot allow vendors to target ads based on sensitive data like religion or ethnicity, staying in line with global 2026 advertising ethics.
16. Verification of “Pro” Badges
- 16.1 Authenticity: If a vendor has a “Verified” or “Pro” badge, you must have a documented process for how they earned it (e.g., they passed a code audit or provided a valid business license).
- 16.2 Review Integrity: Fake reviews (vendors buying their own products to leave 5 stars) are strictly prohibited. If caught, the “Verified” status will be revoked immediately.
17. Minor Protection (Safety for Students)
- 17.1 Age Appropriateness: Since DigiTechPak sells digital tools, you must ensure no “Adult Content” or “Gambling Scripts” are listed.
- 17.2 Data Privacy for Minors: If a user is under 18 (e.g., a student buying a project), you are legally prohibited from showing them targeted ads based on their behavior.
